Legislative Update

The 1st regular session of the 122nd South Carolina General Assembly has adjourned. The following legislation pertaining to energy and transportation was introduced and discussed this session:
During this session the following bills were carried forward to the next session.
 
S 0044 – (similar to H 3079) - A bill to Amend Section 12-37-220, as amended, Code of Laws of South Carolina, 1976 relating to property tax exemptions for renewable energy resources
 
S 261 (similar to H 3304) – SC Commercial Property Assessed Clean Energy Act - A bill to amend Title 6 of the 1976 Code, relating to local governments, by adding Chapter 39, to enact the South Carolina Commercial-Property Assessed Clean Energy Act (C-PACE).
 
S 579 – Building Codes - A bill to amend Section 6-9-5 relating to public policy for building codes, and to restrict enforcement of energy codes by local building officials.
 
S 581 – (H 4065) Income Tax Credit - A bill to add Section 12-6-3697 so as to allow for an income tax credit for the incremental costs or conversion costs of the amount expended to purchase or convert an alternative fuel heavy-duty vehicle, alternative fuel vehicle, and a bio-fuel alternative fuel vehicle
 
S 590 – (H 4253) Energy Standards Appeal Procedures - A joint resolution to approve regulations of the Department of Labor, Licensing and Regulation - Building Codes council, relating to energy standards appeal procedure, designated as Regulation Document Number 4715, pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code.
 
H 3079 – Property Tax Exemption - A bill to amend Section 12-37-220, as amended, Code of Laws of South Carolina, 1976 relating to property tax exemptions, so as to exempt 80% of the fair market value of certain distributed energy resources and to exempt the value of renewable energy resource property for residential use.
 
H 3320 – SC Sales Tax Exemption - A bill to amend Section 12-36-2120, as amended, Code of Laws of South Carolina, 1976, relating to exemptions from the state sales tax, so as to include the gross proceeds of sales or the sales price of machinery, machine tools, and parts of them, used in production of electricity from a renewable energy source.
 
H 3343 – South Carolina Education School Facilities Act - A bill to amend the Code of Laws of South Carolina, 1976, by adding Chapter 158 to Title 59 so as to enact the South Carolina Education School Facilities Act to provide financial assistance to school districts in order to acquire school facilities by using general obligation bonds and provide for other related provisions in connection with the construction or renovation of school facilities
 
During this session the following bill was passed, ratified on May 9, 2017, vetoed by the Governor, and later overridden by both the House and Senate.
H 3516 (S 054) – SC Infrastructure and Economic Development Reform Act - A bill to amend Section 12- 28-310, relating to highway funding
